Local Maintenance of Equity (MOEquity) – Updated FAQs and Deadlines

TEA has been working with USDE and other stakeholders to answer some critical outstanding questions regarding local MOEquity. With sincere appreciation for your patience, this bulletin provides an easy-reference summary of issues and current guidance (also available in the updated MOEquity Handbook), along with details on new training and next steps.

Data for the MOEquity Tool

  • Budgeted vs. Actual Expenditures: LEAs must use the board-adopted budget in effect at the PEIMS fall snapshot date and use this budget data consistently to make comparisons across all three fiscal years (FY21 to FY22, and FY22 to FY23).
  • FTEs to be Included: USDE has confirmed that LEAs must include all FTEs performing campus-level services, including those funded with federal funds. Please see MOQ-Q20–Q22 in the ESSER FAQs for additional information.

LEA Self-Certification/Appendix B Updates

  • TEA has updated the self-certification language to reflect that LEAs are certifying that the LEA will “not implement an aggregate reduction in combined State and local per-pupil funding in FY22.” In other words, the LEA could complete the self-certification if it has a reduction in combined State and local per-pupil funding at some campuses if there was not a reduction in combined State and local per-pupil funding across the entire LEA.
  • LEAs that are now eligible to complete the self-certification should submit a new MOEquity Document Submission Plan. No other action would be required by the LEA.

Updates to Prepopulated Data in MOEquity Tool

  • LEAs that need to update any of the prepopulated data in the local MOEquity Tool should email compliance@tea.texas.gov to request a manual MOEquity Tool.

Existing FAQs

LEAs are encouraged to review existing local MOEquity FAQs by accessing the ESSER FAQs and sorting by “Maintenance of Equity” in the “Category” column of the Smartsheet. To submit a new question, please use the ESSER FAQ submission form.

Additional Training Opportunity

  • On Monday, February 7, 2022, FFCR will provide an additional local MOEquity training opportunity that will include the updated questions/guidance received. The training will take place from 1:30pm to 3:00pm Central Time. Interested ESCs and LEAs should click here to register.
  • Please note that the training will be recorded and a copy of the slide deck will be posted on the MOEquity webpage following the presentation.

Next Steps and Deadlines:

  • LEAs that are not automatically excepted must complete and submit the MOEquity Document Submission Plan by 5:00 p.m. Central Time on Friday, March 4, 2022.
  • LEAs that select to complete the MOEquity Tool must upload the tool into GFFC Reports and Data Collections by 5:00 p.m. Central Time on Friday, March 11, 2022.
