The following rule actions were filed with the Texas Register on December 20, 2019, for publication in the January 10, 2020 issue:

 

Proposed Repeal of 19 TAC Chapter 61, School Districts, Subchapter AA, Commissioner's Rules on School Finance, §61.1011, Additional State Aid for Tax Reduction (ASATR)

Summary: The proposed repeal is necessary because the authorizing statute expired September 1, 2017.

Publication in the Texas Register: January 10, 2020

Public Comment Period: January 10, 2020-February 10, 2020. A form for submitting public comments is available on the proposed commissioner of education rules web page.

Proposed Effective Date: April 13, 2020

 

Proposed New 19 TAC Chapter 61, School Districts, Subchapter FF, Commissioner's Rules Concerning Veterans and Military Dependents, Division 2, Military-Connected Students, §61.1063, Purple Star Campus Designation

Summary: The proposed new rule would implement Senate Bill 1557, 86th Texas Legislature, 2019, by adopting in rule the criteria campuses must demonstrate in order to qualify to apply for and earn the Purple Star Designation.

Proposed Effective Date: April 13, 2020

Adopted Revisions to 19 TAC Chapter 62, Commissioner's Rules Concerning the Equalized Wealth Level, §62.1001, Authority of Trustees; Duration of Agreements; §62.1011, Election Duties of Board of Trustees; §62.1031, Date of Agreement for Purposes of Determining Election Date; §62.1041, Weighted Students in Average Daily Attendance for Purposes of Tax Rate Rollback; and §62.1051, Definition of Parcel Detached and Annexed by Commissioner

Summary: The adopted revisions implement House Bill 3, 86th Texas Legislature, 2019, by removing an outdated provision and updating references to statute. The revisions were adopted without changes since published as proposed.

Effective Date: January 8, 2020

 

Adopted Amendments to 19 TAC Chapter 102, Educational Programs, Subchapter JJ, Commissioner's Rules Concerning Innovation District, §102.1309, Prohibited Exemptions, and §102.1315, Termination

Summary: The adopted amendments reflect changes made by House Bill 3, 86th Texas Legislature, 2019, by reflecting the recodification of Texas Education Code, Chapters 41 and 42, and specifying additional reasons the commissioner may terminate a district's designation as a district of innovation. The amendments were adopted without changes since published as proposed.

Effective Date: January 8, 2020

Summary: The adopted new rule reflects changes made by House Bill 3, 86th Texas Legislature, 2019. The new section was adopted without changes since published as proposed.

Effective Date: January 9, 2020

Summary:
The proposed rule actions were published in the June 28, 2019, issue of the Texas Register (44 TexReg 3213). Notice of the withdrawal will be published in the January 17, 2020 issue of the Texas Register.
Effective Date of Withdrawal: December 31, 2019

 

Commissioner of Education Rule Review

 

The following rule review notice was filed with the Texas Register for publication in the January 10, 2020 issue. To view the notice in the Texas Register, go to the Secretary of State website.

 

Proposed Review of Chapter 103. The Texas Education Agency proposes the review of existing rules in 19 TAC Chapter 103, Health and Safety, Subchapter AA, Commissioner's Rules Concerning Physical Fitness; Subchapter BB, Commissioner's Rules Concerning General Provisions for Health and Safety; Subchapter CC, Commissioner's Rules Concerning School Safety and Discipline; and Subchapter DD, Commissioner's Rules Concerning Video Surveillance of Certain Special Education Settings, pursuant to Texas Government Code, §2001.039.

Summary: As required by Texas Government Code, §2001.039, the TEA will accept comments as to whether the reasons for adopting 19 TAC Chapter 103, Subchapters AA-DD, continue to exist.
