Commissioner of Education Rules
The following rule actions were filed with the Texas Register on December 20, 2019, for publication in the January 10, 2020 issue:
Summary: The proposed repeal is necessary because the authorizing statute expired September 1, 2017.
Publication in the Texas Register: January 10, 2020
Public Comment Period: January 10, 2020-February 10, 2020. A form for submitting public comments is available on the proposed commissioner of education rules web page.
Proposed Effective Date: April 13, 2020
Summary: The proposed new rule would implement Senate Bill 1557, 86th Texas Legislature, 2019, by adopting in rule the criteria campuses must demonstrate in order to qualify to apply for and earn the Purple Star Designation.

The following rule actions were filed with the Texas Register on December 19, 2019, for publication in the January 10, 2020 issue:
Summary: The adopted revisions implement House Bill 3, 86th Texas Legislature, 2019, by removing an outdated provision and updating references to statute. The revisions were adopted without changes since published as proposed.
Effective Date: January 8, 2020
Summary: The adopted amendments reflect changes made by House Bill 3, 86th Texas Legislature, 2019, by reflecting the recodification of Texas Education Code, Chapters 41 and 42, and specifying additional reasons the commissioner may terminate a district's designation as a district of innovation. The amendments were adopted without changes since published as proposed.
Effective Date: January 8, 2020

Withdrawal of Proposed Amendment to 19 TAC Chapter 97, Planning and Accountability, Subchapter EE, Accreditation Status, Standards, and Sanctions, Division 1, Status, Standards, and Sanctions, §97.1051, Definitions, and Proposed New §97.1060, Considerations Regarding Needs Improvement Rating
Summary: The proposed rule actions were published in the June 28, 2019, issue of the Texas Register (44 TexReg 3213). Notice of the withdrawal will be published in the January 17, 2020 issue of the Texas Register.
Effective Date of Withdrawal: December 31, 2019
Commissioner of Education Rule Review
The following rule review notice was filed with the Texas Register for publication in the January 10, 2020 issue. To view the notice in the Texas Register, go to the Secretary of State website.
Proposed Review of Chapter 103. The Texas Education Agency proposes the review of existing rules in 19 TAC Chapter 103, Health and Safety, Subchapter AA, Commissioner's Rules Concerning Physical Fitness; Subchapter BB, Commissioner's Rules Concerning General Provisions for Health and Safety; Subchapter CC, Commissioner's Rules Concerning School Safety and Discipline; and Subchapter DD, Commissioner's Rules Concerning Video Surveillance of Certain Special Education Settings, pursuant to Texas Government Code, §2001.039.
Summary: As required by Texas Government Code, §2001.039, the TEA will accept comments as to whether the reasons for adopting 19 TAC Chapter 103, Subchapters AA-DD, continue to exist.
