Draft for Public Comment: Title I, Part A of the Elementary and Secondary Elementary Act (ESEA) of 1965, as Amended by the Every Student Succeeds Act (ESSA): Providing Equitable Services to Eligible Private School Children, Teachers, and Families Nonregulatory Guidance (Draft Updated Non-Regulatory Guidance, March 11, 2019)

The U.S. Department of Education (Department) has released DRAFT Title I, Part A of the Elementary and Secondary Education Act of 1965, as Amended by the Every Student Succeeds Act: Providing Equitable Services to Eligible Private School Children, Teachers and Families – Updated Non-Regulatory Guidance (2019) for stakeholder review and comment.  This document consolidates and updates information previously included in multiple documents and is intended to support State educational agencies (SEAs), local educational agencies (LEAs), and private school officials in the implementation of the equitable services requirements under Title I, Part A of the Elementary and Secondary Education Act of 1965, as amended by the Every Student Succeeds Act (ESEA). 

Anyone may submit comments during the open comment period. Please share the public comment notice with schools, districts, public/private organizations, parents, and other stakeholders.

Public Comments are due to EquitableServices@ed.gov by March 26, 2019.

2019-2020 Affirmation of Consultation with Private Nonprofit (PNP) School Officials

Federal law requires private schools to be contacted annually by the LEA to determine if PNPs would like to participate with federal programs. It is the responsibility of the Local Education Agency (LEA) to ensure consultation with the private schools is timely and meaningful. Consultation must occur during the design and development of the programs and before the LEA makes any decisions affecting the opportunities of eligible private school children, teachers, and other educational personnel to participate in the programs. LEAs are required to document that timely and meaningful consultation with PNP officials has occurred.

The 2019-2020 PNP Affirmation of Consultation with Private School Officials and Title IV, Part B Affirmation of Consultation with PNP Officials (21st Century Learning Centers) templates are available for download through the Every Student Succeeds Act (ESSA) Reports. Please refer to the Affirmation of Consultation instructions for additional guidance through TEA’s Transition to ESSA webpage: https://tea.texas.gov/Finance_and_Grants/Grants/ESSA_Private_School_Equitable_Services.

Completed 2019-2020 Affirmations for PNPs participating with Title I, Part A; Title I, Part C Migrant; Title II Part A; Title III, Part A English Learner; Title III, Part A Immigrant; Title IV, Part A; and/or Title IV, Part B (21st Century Learning Centers) services should be electronically signed if the LEA and PNP has Adobe Acrobat (not Adobe Reader) software or scanned with written signatures.

Please complete the form fields electronically before submission to the TEA. The signed Affirmation must be uploaded through the ESSA Reports accessible through TEAL no later than September 3, 2019. The LEA only submits an Affirmation if PNPs are participating in one or more federal programs.

PNP Transferability Calculation Tables

TEA is providing the PNP Equitable Services Calculator as an LEA resource tool. The LEA can determine the equitable share for each program with private school participation. In addition, the tool will determine the impact on the equitable share for LEAs that are electing to utilize the Funding Transferability option under Title V, Part A.  This is a planning tool and not the official published equitable share amount that is calculated in the ESSA Consolidated Application for Federal Funding.  At the discretion of the LEA and/or private school, the worksheets may be printed and maintained locally.  https://tea.texas.gov/Finance_and_Grants/Grants/ESSA_Private_School_Equitable_Services

PS3099 Schedule for Private School Services

The 2019-2020 PS3099 Private School Services schedule will be available in eGrants once the 2019-2020 Every Student Succeeds Act (ESSA) Consolidated Application opens in June.
