Updates to the New Source Performance Standards (NSPS) Part 60 Subpart OOOOb, effective May 7, 2024, require storage vessels or tank batteries to demonstrate 95% reduction in methane and volatile organic compounds (VOC) emissions.
Facility owners/operators can voluntarily demonstrate that the standards of NSPS OOOOb don’t apply to their facility by submitting Legally and Practicably Enforceable (LPE) Criteria.
The Air Permits Division of TCEQ has developed form LPE-CERT to certify LPE criteria for a single storage vessel or tank battery under NSPS OOOOb for the Oil and Natural Gas Sector.
The LPE-CERT form is not intended to update permit representations; instead, the form should be used to supplement permit representations for the purposes of NSPS OOOOb.
How to Submit LPE Certification:
Print out and mail in the completed certification form with required attachments as indicated on the LPE-CERT form.
