Posting Applications Online by TCEQ
TCEQ is continuing to implement changes recommended by the Sunset Advisory Commission. One Sunset recommendation directed TCEQ to post electronic copies of applications online as a helpful tool for public access to pending applications.
Starting June 1, 2024, TCEQ will post electronic copies of certain applications and associated documents online. Applicants will be asked for an electronic copy of the application at various stages of the review process, such as administratively complete and technically complete stages. The exact stage depends on the type of application. The electronic copy provided should be the current and complete version with revisions and replacements made throughout the application and without redline or strikeout text. Electronic copies of notice of deficiency (NOD) responses will also be necessary.
This new posting requirement impacts applications declared administratively complete after June 1st. Applications declared administratively complete before June 1st are not impacted.
This change does not remove the requirement for physical copies of the application to be available for viewing at a public location.

Proposed Rule Revisions for Legislative Implementation and Other Programmatic Changes
TCEQ is proposing revisions to Chapters 281, 328, 330, and 335. The 30-day comment begins on May 24, 2024 and a hybrid public hearing is scheduled for June 20, 2024. The purpose of this rule making is to:
- Implement advanced recycling legislation (HB 3060, 2023 Legislative Session) in Chapters 328, 330, 335.
- Add a requirement for applicants to submit an electronic application to the agency in Chapter 281. And remove Chapter 330 rules requiring MSW applicants to post certain applications online.
- Update Chapter 330 to conform to hazardous waste rules related to very small quantity generator.
- Make minor updates to Chapters 330 and 335 by fixing incorrect rule citations and references.
