The IHW Permits Section has Recently Updated the Following Permit Modification Forms:

  • Class 1 Permit Modification Form
  • Class 1ED Permit Modification Form
  • Class 2 Permit Modification Form

These revised forms have been designed with user-friendliness in mind, with the primary goals of simplifying the process and providing clear instructions for the regulated community. Additionally, these updated forms are now suitable for use by commercial industrial nonhazardous waste storage or processing facilities.

Notably, the Class 2 Modification Form has been modified to include instructions for obtaining the mailing list of individuals requiring notification in accordance with 30 TAC 39.413(11).

The use of the revised forms is effective January 2024. Visit the IHW program Forms and Guidance webpage to download the latest applications, forms and guidance.


Groundwater e-Reporting System

The Waste Permits Division is currently in the process of developing an electronic reporting system tailored for the submission of groundwater monitoring data and reports. This system will serve as a comprehensive platform, not only facilitating information submission but also conducting thorough data quality and validation checks to preemptively identify errors before submission to the TCEQ.

Furthermore, this system will contribute to efficient reviews by furnishing project managers with a standardized summary of critical report information.

In the interest of refining the format of data migration templates and ensuring a thorough testing phase, we are actively seeking volunteers to join a stakeholder group. Members of the stakeholder group will provide feedback on usability of the system, templates, and the submission process. If you wish to participate, express your interest by contacting us at IHWPER@tceq.texas.gov.

The development timeline for this system is slated for completion in late 2024. TCEQ will send additional information pertaining to user training and the implementation process as development progresses. Your participation is integral to the success of this initiative, and we appreciate your potential contribution to this endeavor.


No More Plastic Binders with Paper Submittals to IHW Permits

Binder

Please help us reduce waste by no longer submitting any paper responsive information bound by plastic binders. This is applicable to all correspondence including permit applications, permit renewals, permit modifications, combustion, and groundwater reports.

Hard copies of responsive information can be submitted using paper accordion folders or expanding paper folders. Submit electronic files to IHWPER@tceq.texas.gov. If the electronic files are larger than 25 MB, you can submit the files using our TCEQ FTPS website.


Notice of Rulemaking

The Waste Permits Division has initiated a project to revise its rules to implement House Bill (HB) 3060, passed by the 88th Legislature (Rule Project Number (RPN) 2023-135-330-WS). Advanced recycling rules associated with HB 3060 are planned for adoption in 30 TAC Chapters 328 and 335. The rulemaking will also revise 30 TAC 281.5 to require an identical electronic copy of applicable permit applications, and update Chapter 335 to correct outdated rule citations or references. The rulemaking will be presented to the Commissioners for proposal in April or May of 2024, followed by a formal public comment period Summer 2024.

The Location Mapper allows you to plot a point for a facility, generate a URL, and send that URL to someone else. You can use an address or latitude and longitude to search for a location. The Location Mapper can be found here: https://gisweb.tceq.texas.gov/LocationMapper/


Meet our New IHW Permits Section Members


New Team Leader, Colin Donovan

Help us welcome Colin Donovan as the new Team Leader for Team II.

Colin earned a Master's in Public Administration (Environmental Policy focus) from North Carolina State University. Colin worked at Texas Commission on Environmental Quality for almost seven years in the Office of Air - Texas Emissions Reduction Plan. Since then, he worked for Austin Energy, and most recently for the Texas General Land Office.

New Technical Specialist, Lance Christian

 

We are pleased to announce Lance Christian has joined the IHW Section as the new Technical Specialist.

Lance started with the State at the Texas Water Development Board, Groundwater Resources Division in 2006 and later transitioned to the Railroad Commission of Texas, Groundwater Advisory Unit in 2013. Most recently he was privately employed as a sub-surface mapping geologist.
