Assistant General Counsel

Essential Functions

    The Office of the General Counsel works as a team to provide legal advice and direction to ERS' trustees and staff to enable them to undertake their duties to act in the best interest of ERS' members and retirees effectively and efficiently.  The Assistant General Counsel performs advanced professional legal work that involves regular contact with various division directors, as well as with the legal staffs of the Attorney General's Office, insurance companies, third party administrators, health maintenance organizations, investment advisers and other entities with whom the agency contracts under the general direction of the Deputy Executive Director and General Counsel.

    Essential Functions (includes the tasks listed below, but not limited to):

    • Drafts and reviews documents, including pleadings, discovery requests and responses, motions, opinions, briefs, abstracts, petitions, summary judgments, legal correspondence, insurance and employee benefits-related documents, as well as other legal documents.
    • Handles all aspects of contested cases, including investigation, discovery, pleadings, hearings, etc.
    • Presents agency's position at administrative hearings and before the Board of Trustees when required.
    • Assists the Attorney General of Texas with litigation matters involving the agency.
    • Handles subrogation, fraud and debt collection cases.
    • Interprets laws and regulations and gives legal advice.
    • Performs extensive legal research on matters affecting ERS; responsible for interpreting, applying and enforcing laws and regulations on behalf of ERS.

    • Oversees and/or provides legal advice and opinions on policy decision-making to agency management and identifies appropriate legal solutions.

    • Drafts, reviews, analyzes and interprets pending legislation, bills and rules.

    • Advises agency management on the development of appropriate solutions to the legal needs of internal business operations.
    • Maintains and monitors deadlines on assignments.
    • Plans, assigns and/or supervises work of legal staff, as needed.

      Required Minimum Qualifications

      Your application for employment must reflect how you meet each of the following minimum qualifications:

        1. Graduation from an accredited law school with a juris doctorate degree, licensed to practice law in the State of Texas and an active member in good standing with the State Bar of Texas.
        2. Four (4) years’ experience in the practice of law, with at least one (1) year of experience in administrative law and/or civil trial/appellate law. 
        3. Four (4) years’ experience analyzing and solving legal problems and drafting, interpreting, reviewing and negotiating legal documents. 
        4. Two (2) years’ experience addressing an audience. 
        5. Demonstrated experience and skills in legal research and writing.

          Preferred Qualifications

                 6.   Experience in the area of state agency constitutional and statutory authority, insurance law, litigation, and employee benefits-related law.
