A Spooky Good Update!

While it may feel like a bit of a “trick” that TDLR inspectors are out performing inspections this fall, it’s really a “treat” for the entire mold industry!

Our inspections aren’t about catching you off-guard, they’re about answering questions, educating licensees, protecting the public, and providing expert guidance to help keep everyone in compliance and confident in their work.

The Mold Program Team Has Been Out and About!

Our inspectors have been busy conducting inspections and outreach across Texas. With the passing of S.B. 1255 and the upcoming review of the Mold Program Rules, change is in the air (and not just the crisp fall breeze!).

When conducting inspections, our inspectors look for areas where compliance may have slipped through the cracks—it’s similar to finding hidden cobwebs in the corners. The inspector’s role is to identify gaps or violations, help correct them where possible, and bring everyone into alignment with the law and rules.

Remember, TDLR inspectors also  are educators. Please ask questions during an inspection—our team truly welcomes the Q&A. After all, we’re here to ensure the mold industry runs safely, smoothly, and with less fright and more insight!


A Common “Boo!”-Boo to Avoid: Not Preparing A Work Plan For All Projects

Recently, an inspection revealed a common misunderstanding—that a work plan is not required for projects under 25 contiguous square feet (CSF). This is one spooky myth!

According to both statute and rule, a work plan is always required for any remediation project, regardless of size.

According to the Law: Texas Occupations Code, Sec. 1958.152 – Remediation Work Plan

  • (a) A license holder who intends to perform mold remediation shall prepare a work plan providing instructions for the remediation efforts to be performed for the mold remediation project. The license holder shall provide the work plan to the client before the mold remediation begins.
  • (b) The license holder shall maintain a copy of the work plan at the job site where the remediation is being performed.

In the Rules:

  • §78.58(b)(1) – Preparing a mold remediation work plan providing instructions for remediation activities.
  • §78.58(f)(11) – Properly prepare each mold remediation work plan.
  • §78.58(f)(12) – Provide the client with a mold remediation work plan at least one calendar day before preparation work begins.
  • §78.120(b) – Each project must have a specific work plan fulfilling all protocol requirements.
  • §78.120(c) – A current copy of the mold remediation work plan must be maintained onsite.

In Short:

No matter the size of the project, if you’re licensed as a Mold Remediation Contractor conducting remediation, a work plan is required.
