Proposed Plastic Bag Ordinance
Lower Merion Township is considering a new ordinance
to reduce plastic pollution.
The Lower Merion Township Board of Commissioners Sustainability Committee is discussing the ordinance again on May 3, 2023. Visit the Township Calendar for information about how to participate.
The proposed ordinance would ban single-use plastic carry out bags from retail establishments.
Customers are encouraged to BYOB - Bring Your Own Bag, Lower Merion!
The proposed ordinance allows retailers to provide consumers with recyclable paper bags or reusable bags at the point of sale, for a charge of $0.10 per bag. In the draft ordinance:
- The retail business keeps the bag fee.
- The bag fee must be separately stated on the customer's receipt.
The proposed ordinance affects certain retail businesses such as restaurants, clothing stores, convenience stores, drugstores, farmer's markets, grocery stores, and other general merchandise retailers. It does not apply to dry cleaners, food banks, food pantries, senior citizen centers or similar meal centers operated by nonprofit or governmental organizations or religious institutions, or commercial establishments operated by Commonwealth, Federal or local government agency.
Single-use plastic carry out bags include plastic bags that are provided by establishments at the point of sale. They do not include product packaging, newspaper bags, dry cleaning bags, bags used to wrap raw food products, or bags sold in packages containing multiple bags, such as garbage bags, lawn bags or pet waste bags.
Retail businesses and residents will have several months to comply, since the proposed ban would take effect six (6) months after the Board of Commissioners approves it.
