WHAT: On September 12, 2024, the proposed rules for Groundwater Allocation are set to be considered for adoption by the Water Resources Commission. If the Commission adopts the proposed rules at the September meeting, they will go into effect upon filing with the Secretary of State, unless otherwise directed by the Commission during adoption.

WHY: The proposed rules update how OWRD determines if water is available to support new groundwater rights. The proposed rule changes are not intended to impact exempt groundwater use, existing water rights, water rights transfers, or groundwater applications in the agency queue at the time of rule adoption.
The proposed rules clarify and update key terminology and processes used for decision-making when issuing new groundwater rights. Under the proposed rules, water is considered available if the groundwater levels are reasonably stable, the proposed groundwater pumping does not interfere with surface water flows and the aquifer can produce the water at the full amount of water requested. In practice, this would mean overall fewer new water right applications would be granted.
