Official Notice of Temporary Administrative Order

Dear Interested Parties:
You are receiving this email notification because you asked us to let you know about news from the State Archives Records Management Unit.
We have filed a Temporary Administrative Order, including the Statement of Need and Fiscal Impact, with the Secretary of State’s Office. This will be published in the Oregon Bulletin on April 1, 2025. We have included a summary of the proposed administrative rule amendments at the end of this notice.
Justification of Temporary Filing:
- As the current rules reference an obsolete standard it is impossible for agencies to comply with it. Leaving it in place is both confusing and legally problematic.
- All public entities in Oregon are subject to these rules, so thousands of different units of government are affected.
- Agencies attempting to maintain electronic records in compliance with State Archives requirements are unable to do so with the current language. This temporary action is necessary to provide the needed time to develop clear and useful replacement language.
- The temporary language provides broad guidelines for compliance as a stopgap until more specific standards can be developed. This will allow agencies to remain in compliance while still safeguarding the records in their care.

Summary of Amended Administrative Rules:
OAR 166-0017-0045: Removes references to obsolete standard, inserts language to provide guidance for storage of electronic records.
Summary of Suspended Administrative Rules:
OAR 166-017-0025: Suspends current obsolete language referencing withdrawn standard in anticipation of a re-write.
