Short Summary
The Elections Division hereby provides notice of administrative rulemaking activity for proposed changes to OAR 165-012-0005. This rule amendment would implement section 9 of SB 1538 and provide other clarifications. Additional campaign finance reform under SB 1538 and HB 4024 will be implemented at a later date. RULE SUMMARY: The amendments to this rule and the associated manual and forms account for changes set out in Senate Bill 1538 Section 9 (2024) by extending the guidance for allowable legal expenses to include using committee funds for proceedings under a campaign finance provision of a county charter or ordinance, a campaign finance provision of a city charter or ordinance, or any charter or ordinance provision adopted under the authority of ORS 260.163. Additionally, it clarifies the timeline for filing transactions when a candidate exceeds the $750 threshold and is required to form a committee.
CHANGES TO RULE: The proposed changes to OAR 165-012-0005 can be found at the State Archives division's website and the Elections Division's website.
NEED FOR RULE: The proposed amendment would adopt an updated version of the Campaign Finance Manual. This administrative rule is needed to implement the provisions of SB 1538 (2024). Without this rule, committees and other filers would not have the information they need to comply with Oregon campaign finance laws and rules.
