Designating the Candidate's Manual, Minor Political Party Manual and Forms

The Elections Division hereby provides notice of a permanent administrative order for OAR 165-010-0005. Prior to the effective date of the administrative rule, the Elections Division held a public hearing and accepted public comments.

RULE SUMMARY: The changes to this rule and the associated manuals and forms implement House Bill 3073 (2023), Senate Bill 585 (2023) and Senate Bill 166 (2023). This rule also sets a signature verification deadline of 30 days for political party formation petitions. House Bill 3073 (2023) allows candidates and elected officials to limit the public accessibility of candidate’s residence address from the candidate filing form and voter registration lists. Senate Bill 585 (2023) removes requirement that candidates seeking the office of precinct committeeperson be registered to vote in the precinct no later than the 251st day before the primary election if the individual becomes a U.S. citizen between the
251st day and the deadline to file a declaration of candidacy. Senate Bill 166 (2023) changes the filing officer for certain judicial candidates from the Secretary of State to county elections officials. Additional changes were made throughout the manuals to update filing deadlines and provide clarity for the various processes related to candidacy filings. The State Candidate’s Manual adopted by this rule does not make any new changes related to Measure 113 (2022). However, it does incorporate the changes previously noticed by temporary rule dated August 8, 2023, related to Measure 113 (2022); that notice stated: “This rule updates the State Candidate’s Manual to incorporate the requirements of Article IV, section 15, of the Oregon Constitution, as amended by Ballot Measure 113 (2022). It clarifies, consistent with the intent of the majority of Oregonians who voted on Ballot Measure 113, that the requirements of Article IV, section 15, apply to incumbent State Senators and State Representatives who seek to stand for re-election in November 2024. This includes any incumbents seeking to stand for re-election in 2024 who accrued ten or more unexcused absences during the 2023 Legislative Session. Pursuant to Article IV, section 15, those incumbents may complete their current term, but are disqualified from holding legislative office for (and are ineligible to
run for) the immediately following term".
