OAR 165-024-0005

DEFINITIONS

FILING CAPTION: Defines terms to implement HB3021 and rules requiring translation of voters’ pamphlets.

RULE SUMMARY: HB 3021 (2021) created provisions codified in ORS Chapter 251 requiring the Secretary of State to adopt rules necessary for implementing the translation of voters’ pamphlets, including using the best available and appropriate data to determine and publish the lists of most commonly spoken languages in Oregon, coordinating with county and state election officials to produce professionally translated pamphlets in multiple languages, accepting and reviewing candidate’s and filers’ translated candidate statements and measure arguments, establishing and consulting with a Translation Advisory Council, and translating and posting pamphlets for all elections beginning with the 2022 General Election. This rule explains the definitions the Secretary of State will use to fulfill the law and related rules, OAR 165-024-0005 to OAR 165-024-0030.

NEED FOR RULE: In enacting HB3021 (2021) the Legislative Assembly directed the Secretary of State to adopt rules to implement translation activities. This rule is needed to define the terminology of implementation in time for the 2022 General Election.

TRANSLATION ADVISORY COUNCIL

FILING CAPTION: Enacts HB3021 establishing a Translation Advisory Council.

RULE SUMMARY: HB 3021 (2021) created provisions codified in ORS Chapter 251 requiring the Secretary of State to adopt rules necessary to convene and consult with a Translation Advisory Council for the translation of county and state voters’ pamphlets materials for primary, general, and local elections, beginning with the 2022 General Election.  This rule implements the process and requirements necessary to convene and consult with a Translation Advisory Council.

CHANGES TO RULE: OAR 165-024-0010 is a proposed new permanent rule and can be found at the State Archives Division's website and the Elections Division's website. [link to the text of the proposed changes on both websites]. 

NEED FOR RULE: In enacting HB3021 (2021) the Legislative Assembly directed the Secretary of State to adopt rules to convene and consult with a Translation Advisory council to validate translations of voters’ pamphlets in multiple languages prior to the 2022 General Election. This rule is needed to ensure the timely recruitment, orientation, and organization of a twenty-plus member Council.

LANGUAGE LISTS FOR TRANSLATION OF SELECTED STATE AND COUNTY VOERS' PAMPHLET MATERIALS

FILING CAPTION: Enacts HB3021 by defining data and language lists for translations of voters’ pamphlets.

RULE SUMMARY: HB 3021 (2021) created provisions codified in ORS 251 requiring the Secretary of State to translate state and county voters’ pamphlets into the most commons state and county languages determined by census data. This rule implements the requirements necessary to determine the lists of state and counties’ most commonly spoken languages and make the lists of languages publicly available.

CHANGES TO RULE: OAR 165-024-0015 is a proposed new permanent rule and can be found at the State Archives Division's website and the Elections Division's website

NEED FOR RULE: In enacting HB3021 (2021) the Legislative Assembly directed the Secretary of State to use the best available population data, promptly establish lists of state and county languages for the translations of pamphlets and make those lists of languages available online. This rule is needed to establish the lists of languages and related translation activities to meet voters’ pamphlet statutory deadlines.

PROFESSIONAL TRANSLATIONS OF SELECTED STATE AND COUNTY VOTERS' PAMPHLET MATERIALS

FILING CAPTION: Implements HB3021 requiring the professional translation of voters’ pamphlets.

RULE SUMMARY: HB 3021 (2021) created provisions codified in ORS Chapter 251 requiring the Secretary of State to adopt rules necessary for implementing the professional translation of county and state voters’ pamphlet materials for all primary, general, and special elections beginning with the 2022 General Election. This rule implements a clear process the Secretary of State will use to perform high quality translations.

CHANGES TO RULE: OAR 165-024-0020 is a proposed new permanent rule and can be found at the State Archives Division's website and the Elections Division's website

NEED FOR RULE: This rule is needed to ensure the Secretary of State selects translators who possess a level of qualification and relevant experience appropriate to translating state and county voters’ pamphlet materials into multiple languages.
