Translation Advisory Council

The Elections Division hereby provides notice of rulemaking activity for OAR 165-024-0005, -0010, -0015, -0020, -0025, -0030. More information may be found below and on our website

The following temporary rules went into effect on September 1, 2022 and will end on February 27, 2023 with the exception of OAR 165-024-0030, which is effective from September 1, 2022 through February 26, 2023.  All of the following temporary rules are subject to sooner repeal upon filing of a superseding permanent order.

FILING CAPTION FOR 165-024-0005: Defines terms to implement HB3021 and rules requiring translation of voters’ pamphlets.

NEED FOR TEMPORARY RULE 165-024-0005: In enacting HB3021 (2021) the Legislative Assembly directed the Secretary of State to adopt rules to implement translation activities. This rule is needed to define the terminology of implementation in time for the 2022 General Election.

JUSTIFICATION FOR TEMPORARY RULE 165-024-0005The Secretary of State finds that the failure to act promptly will result in serious prejudice to the public interest of the more than 200,000 Oregon individuals who have limited English proficiency (LEP) and speak one of the most common languages in Oregon other than English. Absent this temporary rule, the state’s LEP individuals would not be able to receive voter information in a culturally appropriate way and fully exercise their voting rights in time for the 2022 General Election.

NEED FOR TEMPORARY RULE 165-024-0010: In enacting HB3021 (2021) the Legislative Assembly directed the Secretary of State to adopt rules to convene and consult with a Translation Advisory council to validate translations of voters’ pamphlets in multiple languages prior to the 2022 General Election. This temporary rule is needed to ensure the timely recruitment, orientation, and organization of a twenty-plus member Council and to meet voters’ pamphlet statutory deadlines.

JUSTIFICATION FOR TEMPORARY RULE 165-024-0010The Secretary of State finds that the failure to act promptly will result in serious prejudice to the public interest of the more than 200,000 Oregon individuals who have limited English proficiency (LEP) and speak one of the most common languages in Oregon other than English. Absent this temporary rule, the state’s LEP individuals would not be able to receive voter information in a culturally appropriate way and fully exercise their voting rights in time for the 2022 General Election.

NEED FOR TEMPORARY RULE 165-024-0015: In enacting HB3021 (2021) the Legislative Assembly directed the Secretary of State to use the best available population data, establish lists of state and county languages to translate pamphlets, and make those lists available online. This temporary rule is needed to ensure the prompt establishment of language lists and related translation activities to meet voters’ pamphlet statutory deadlines for the 2022 General Election.

JUSTIFICATION FOR TEMPORARY RULE 165-024-0015The Secretary of State finds that the failure to act promptly will result in serious prejudice to the public interest of the more than 200,000 Oregon individuals who have limited English proficiency (LEP) and speak one of the most common languages in Oregon other than English. Absent this temporary rule, the state’s LEP individuals would not be able to receive voter information in a culturally appropriate way and to fully exercise their voting rights in time for the 2022 General Election.

NEED FOR TEMPORARY RULE 165-024-0020: This temporary rule is needed to ensure the Secretary of State selects translators who possess a level of qualification and relevant experience appropriate to translating state and county voters’ pamphlet materials into multiple languages for the 2022 General Election prior to the 2022 General Election.

JUSTIFICATION FOR TEMPORARY RULE 165-024-0020The Secretary of State finds that the failure to act promptly will result in serious prejudice to the public interest of the more than 200,000 Oregon individuals who have limited English proficiency and speak one of the most commonly spoken languages in Oregon other than English. Absent this temporary rule, the state’s limited English proficient individuals would not be able to receive voter information in a culturally appropriate way and fully exercise their voting rights in time for the 2022 General Election.

NEED FOR TEMPORARY RULE 165-024-0025: This temporary rule is needed to ensure the timely implementation of HB3021 requiring the professional translation of portions of county voters’ pamphlets into multiple languages and the timely notification of the public of their availability in time for the 2022 General Election. This rule explains the portions of the county voters’ pamphlet for translation and related responsibilities of county election officials.

JUSTIFICATION FOR TEMPORARY RULE 165-024-0025The Secretary of State finds that the failure to act promptly will result in serious prejudice to the public interest of the more than 200,000 Oregon individuals who have limited English proficiency (LEP) and speak one of the most common languages in Oregon other than English. Absent this temporary rule, the state’s LEP individuals would not be able to receive voter information in a culturally appropriate way and to fully exercise their voting rights in time for the 2022 General Election.

Absent this temporary rule, the state’s LEP individuals would not be able to receive voter information in a culturally appropriate way and fully exercise their voting rights in time for the 2022 General Election.
