Republicans Introduce an END to M110

This week, House Republicans introduced legislation to end the crises of drugs, homelessness, and crime that have been exacerbated by the failed Measure 110.

Oregonians are demanding drug addiction treatment and recovery. Our bill delivers on the failed promise of Ballot Measure 110 by incentivizing people to seek treatment and supporting them on the road to recovery. There is dignity in each individual human being. This is the compassionate thing to do for those suffering from drug addiction and for all Oregon communities.

We Can Change This State!

It's up to us to counter the failures of Measure 110 and do what's right - to deliver on true Drug Addiction Treatment and Recovery that the majority of Oregonians are demanding.

Make sure your voices are heard. Show up to town halls! Write your legislators! Meet with them in the Capitol! Show up to committee hearings! Support candidates that are serious about fixing this problem! And vote!

We can change this state; apathy and surrender are our only enemies.

The Plan:

Recriminalize

  • Reclassify Possession of a Controlled Substance to a Class A Misdemeanor.
  • Boyd Fix – Defining “delivery” of a controlled substance to include possession with intent to transfer.
  • Create a new A-Misdemeanor for “Public Use of a Controlled Substance” to align with current law prohibiting public use of alcohol and marijuana.
  • Create a new Class A Misdemeanor for “Use of a Controlled Substance in an Enclosed Public Space that Endangers another Person.” (Escalates to Class C Felony for Repeat Offenses).
  • Creates crime of possession of tableting or encapsulating machines.
  • Taylor’s Law – Increase penalties for manufacture/delivery of controlled substances for repeat offender or if delivery results in death.
  • Repeal provisions of SB 1510 (2022) that allows drug use under supervision.

Reinvest

  • Fund county probation departments to supervise misdemeanor theft and property crime cases where defendants are dealing with an addiction/substance abuse disorder.
  • Prioritize adequate and sustainable funding for Oregon’s Specialty Courts.
  • Create adequate stabilization, detoxification and treatment capacity in jurisdictions throughout Oregon by making sustainable investments in sobering center/stabilization and treatment bed capacity for adults and juveniles.
  • Utilize bonding to make capital investments for treatment and recovery infrastructure.

Rehabilitate

  • Support the establishment of Opioid Overdose Quick Response Teams.
  • Mandate drug treatment for drug-dependent persons convicted of or charged with drug possession or certain misdemeanor property crimes (Shoplifting or car break-ins).
  • Establish authority to utilize welfare holds of up to 72 hours for intoxicated persons who pose a danger to self or others.
  • Create conditional discharge diversion procedures for those charged with drug possession.
  • Automatically expunge misdemeanor drug possession conviction upon completion of drug treatment and probation.
  • Modify the statutory pretrial hold language from SB 48 (2021 Legislative Session) to ensure that jails and judges have the flexibility to hold drug dealers charged with Distributing a Controlled Substance (DCS) and repeat offenders.

Reform

  • Abolish the Measure 110 Oversight and Accountability Council.
  • Send Drug Treatment and Recovery Services Funds to counties and federally recognized tribes through the ADPC to distribute for treatment locally in consultation with the Alcohol and Drug Policy Commission, Local Mental Health Authorities and CCOs.
  • Require ADPC to fund evidence-informed prevention, treatment, recovery support, community harm reduction, enforcement services.
  • Direct the Alcohol and Drug Policy Commission to conduct a gaps analysis and advise counties and the legislature on budgeting and best practices for addressing substance use.
