Good afternoon, As I have mentioned to many of you, I am trying to stay ahead of some Bills of Concern that are coming up for Public Hearings. I am sending you this information so that you may have an opportunity to bring your voice to the Legislative Process.

SB 85 - Requires State Department of Agriculture to study confined animal feeding operations.
The -1 amendment to this bill will bring unneeded overregulation on our producers.

House Committee on Early Childhood & Human Services 1:00 pm
HB 3256 - Prohibits child who is receiving developmental disability services in developmental disability child foster home from being attended by parent or guardian without approval of Department of Human Services. Permits child who attains 18 years of age while receiving developmental disability services in developmental disability child foster home to continue to reside in home until child attains 26 years of age if approved by department.
Senate Committee on Judiciary at 1:00 pm
SB 891 - Modifies provisions relating to Oregon Death with Dignity Act. Expands health care providers authorized to prescribe medication to include physician assistants and nurse practitioners. Repeals residency requirement. Modifies permissible methods of delivering prescription to pharmacist. Reduces certain waiting periods. Authorizes electronic filing of certain reports.

SB 559 - Requires veterinarians to participate in prescription drug monitoring program. Directs Oregon State Veterinary Medical Examining Board to provide Oregon Health Authority with information of individuals licensed by board authorized to prescribe or dispense controlled substances for purposes of qualifying individuals to report information to and receive information from program. Adds practicing veterinarian as member of Prescription Monitoring Program Advisory Commission. Reduces number of public members on commission from two members to one member.

HB 2703 - Expands applicability of requirement to discuss class size and caseload as mandatory subject of bargaining for purposes of school district collective bargaining. Takes effect on 91st day following sine die.
Senate Committee on Human Services 3:00 pm
SB 606 - Establishes Nonprofit Workforce Retention Fund in State Treasury, separate and distinct from General Fund, from which Employment Department must provide grants to qualifying nonprofit organizations for purpose of increasing compensation of and reducing turnover among employees of each recipient nonprofit organization. Sets minimum rate at which specified state agencies may compensate nonprofit organizations for indirect costs related to providing services.
House Committee on Climate, Energy & Environment 3:00 pm
HB 3196 – Authorizes Environmental Quality Commission to establish by rule fee to be paid by community climate investment entities. Establishes Community Climate Investment Oversight Account.

Senate Committee on Labor & Business 8:00 am
SB 850 - Requires public body that procures construction services for certain qualified projects that use $750,000 or more in funds of public agency or moneys made available to state under federal American Rescue Plan Act of 2021 to enter into project labor agreement that, at minimum, provides for payment of wages at or above prevailing rate of wage, to use apprentices to perform at least 15 percent of work hours that workers in apprenticeable occupations perform on project and to establish and execute plan for outreach, recruitment and retention of women, minority individuals and veterans to perform work on project.
This will increase costs for local governments. This puts smaller contractors at a disadvantage.

SB 488 - Requires municipal solid waste incinerator that accepts more than specified amounts of hospital, medical or infectious waste in calendar year to meet federal emissions limits for hospital, medical or infectious waste incinerator.
SB 582 - Requires state agency that authorizes or funds, in whole or in part, installation of electric vehicle charging system located on customer's side of meter to require installing contractor or contractors to hold all legally required licenses and one or more electricians who hold Electric Vehicle Infrastructure Training Program certification to supervise or participate in installation. Requires state agency to require 25 percent of electricians who are present and working on installation to hold Electric Vehicle Infrastructure Training Program certifications when installation is for electric vehicle charging port on customer's side of meter that will supply 25 or more kilowatts to vehicle. Requires Electrical and Elevator Board to approve Electric Vehicle Infrastructure Training Program as continuing education program. Requires Bureau of Labor and Industries to establish program to reimburse individuals who successfully complete Electric Vehicle Infrastructure Training Program and pass certification exam for amount of cost of course and exam incurred by individual. Appropriates moneys from General Fund to bureau for purposes of payments of grants made under program established by bureau.

SB 551 - Requires school districts to provide specified information related to secure storage of medications and firearms.

SB 972 - Requires Oregon Health Authority to transition from healthcare.gov to state-based marketplace by November 1, 2026. Declares emergency, effective on passage.
Senate Committee on Human Services 3:00 pm
SB 230 - Repeals Interstate Compact on the Placement of Children. Enacts Interstate Compact for the Placement of Children.

Senate Committee on Energy & Environment 1:00 pm
SB 803 - Establishes standard for carbon intensity and other characteristics of diesel fuel used in on-road motor vehicles. Establishes timeline for Oregon fuel standard to apply to regions of state. Directs State Department of Agriculture to suspend requirement that fuels meet standard if supply is insufficient to meet anticipated demand. Directs department to suspend requirement that fuels meet standard if price of fuels that meet standard exceeds price of petroleum diesel.
Bill that could eventually ban diesel fuel in Oregon.

SB 854 - Requires each school district board to develop written plan establishing climate change instructional program for kindergarten through grade 12 no later than June 1, 2026.
House Committee On Agriculture, Land Use, Natural Resources & Water 3:00 pm
HB 2238 - Authorizes Director of Department of State Lands to adopt rules establishing fees related to removal or fill permit applications, wetland delineation reports and general authorizations. Removes specified fee amounts from statute. Authorizes method by which Department of State Lands may dispose of personal property left on state lands.

SB 579 - Allows persons convicted of felony to register to vote, update voter registration and vote in elections while incarcerated. Specifies that person's residence is where person resided prior to incarceration.

SB 943 - Establishes Broadband Service Infrastructure Program within Oregon Broadband Office for purpose of offsetting cost of planning and developing high speed broadband service infrastructure in unserved and underserved areas. Requires eligible applicants that are awarded grant or loan to enter into performance agreement to plan and develop broadband service infrastructure within designated geographic area that reaches 95 percent or more of customers in geographic area and provides broadband service at speed of at least 100 megabits per second for downloads and uploads with capability to provide speeds of one gigabit per second for downloads and uploads. Requires Oregon Business Development Department to adopt initial rules and standards to carry out Broadband Service Infrastructure Program no later than December 31, 2023. Clarifies that moneys in Broadband Fund are appropriated to Oregon Business Development Department for purpose of providing grants or loans under program established by rule under section 5, chapter 17, Oregon Laws 2020 (first special session). Requires Oregon Business Development Department, through Oregon Broadband Office, to establish program to provide grants or loans to eligible applicants to support residents and businesses that are located within high-cost broadband service area having access to broadband services at rates that are reasonably comparable to rates in areas that are outside of high-cost broadband service areas. Requires Oregon Broadband Advisory Council to include in biennial report evaluation of continuing need for temporary program for providing grants or loans to support projects for planning and development of broadband service infrastructure and digital literacy, inclusion and adoption.
