“Rank and Serve” is the process districts use to determine which schools will be served with Title I-A funds. The intent of the law is to concentrate the funds in schools with the highest percentages of children from families experiencing poverty and to provide sufficient funds to make a difference in the academic performance of these students. Consultation requirements under section 8538 of the ESEA, as amended by ESSA, require affected local education agencies (LEAs) to consult with Indian tribes (or those tribal organizations approved by the tribes located in the area served by the LEA) prior to submitting a plan or application for covered programs. This requirement is designed “to ensure timely and meaningful consultation on issues affecting American Indian and Alaska Native students.” Covered programs include:
- Title I, Part A
- Title I, Part C
- Title I, Part D
- Title II, Part A
- Title II, Part A
- Title IV, Part A
- Title IV, Part B
- Title V, Part B
- Title VI, Part A
Affected LEAs include those LEAs whose Title VI Award for the previous fiscal year was >$40,000 OR LEAs that are members of a consortium who received >$40,000 in Title VI funds in the previous fiscal year. Affected districts will submit the affirmation of tribal consultation and tribal consultation worksheet.
Because the CIP Budget Narrative for each covered program reflects the district’s plan for funds, approval of narratives for affected LEAs is contingent on submission of the required documents related to tribal consultation. Evidence of consultation is due October 1, 2026. Important resources for Tribal Consultation can be found, at this ODE link and materials should be submitted to FederalPrograms@ode.oregon.gov.

These one-page documents provide examples, by program, when use of funds would not be considered supplemental and are a companion to the Supplement not Supplant Brief and can be found on the ESSA Quick Reference Brief web page.
