Comments on the Interim Final Rule (IFR) on Summer EBT and SFSP Non-Congregate Summer Meals are due August 27, 2024.
This is your chance to give your thoughts directly to USDA on items in this IFR. USDA does take the time to read all the comments and this a great opportunity to get your organization’s thoughts out in front of them. Items in the IFR includes:
- The requirement for sites to either be congregate or non-congregate for the same meal service
- Only allowing parents or guardians to pick up meals when children are not present
- Only allowing self-preparation sponsors (e.g. those without Food Service Management Contracts) to offer bulk meals
Comments on this IFR are being taken on regulations.gov. Again, comments are due August 27, 2024.
ODE CNP wants to hear from sponsors on Summer 2024 non-congregate operations. Feedback is being gathered through two different channels. Sponsors can select which channel is best for them. These options are:
Sponsors of non-congregate meal sites are asked to either complete the survey or schedule a meeting by September 6, 2024. If you have any questions, please contact Cathy Brock at cathy.brock@ode.oregon.gov.

Updated article with information on supporting documentation for heat and air quality waivers.
When submitting SFSP claims, sponsors who are serving non-congregate meals must complete the non-congregate meal section on each SFSP Site Claim. This is in addition to the claim detail section that must be completed for all meals. Non-congregate meals must also be documented in the following boxes/lines on the Site Claim:
- 7C: Include the number of operating days the non-congregate meals were served during the claim month.
- 10: List the specific dates of non-congregate feeding.
- 11 (A-E): List the number of total eligible non-congregate meals by meal type. Only the meal types approved on the Site Information Sheet will be available.

Supporting Documentation:
In addition to submitting non-congregate meal counts separately in the SFSP claims, sponsors who were approved to serve non-congregate meals through a heat or air quality waiver must also remember to save all supporting documentation showing that non-congregate service was only utilized during applicable days.
- Sponsors approved for a heat waiver must:
- Print or save an electronic file of one of the following: National Weather Service Excessive Heat Advisory, Excessive Heat Warning, and/or Excessive Heat Watch for your region.
- Indicate on your Meal Count Sheets that all meals were served as non-congregate meals.
- Sponsors approved for an air quality waiver must:
- Print or save an electronic file of the AQI Purple Flag or Higher from https://www.airnow.gov
- Indicate on your Meal Count Sheets that all meals were served as non-congregate meals.

Much of Oregon has been impacted by wildfires this summer and Ontario was no exception.
Ontario SD was approved to operate multi-day non-congregate meal pick up in July. Demand for these meals from the community has kept staff on their toes, with service of over 700 meal boxes in one day!
“With the smoke from the fires and the extreme heat, we are really fighting an uphill battle,” said Pam Suyematsu, Director of Nutrition Services for Ontario SD. Staff has heard nothing but good things and appreciation for everything, especially the milk, from participants.

ODE CNP has a limited amount of funding to reimburse Oregon SFSP sponsors for sanitation inspections completed during summer meal operations.
To be reimbursed, each inspection must show the sponsor was in compliance or that items out of compliance have been corrected. All payments will be made on a first come-first serve basis.
To submit a request for inspection funds reimbursement, submit the following documents to ode.communitynutrition@ode.oregon.gov by August 31, 2024:
- A copy of the original itemized and legible invoice
- A completed Sanitation Inspection Report for each site inspected - the inspector must write In Compliance or Complied or checked the Complied box and the date of inspection must be during summer meal operations as approved in CNPweb
- A copy of the Sanitation Inspection Reimbursement Form - this is available for download from the Packet Tab of CNPweb
