On October 13, 2022, FNS released CACFP 01-2023, Creditability of Infant Formulas Imported Through the Food and Drug Administration’s 2022 Infant Enforcement Discretion Policy in the Child and Adult Care Food Program.
This guidance is intended to support Child and Adult Care Food Program operators and the families they serve during the ongoing infant formula shortage and provides guidance to State agencies and local program operators on the use of imported infant formulas.
Here is a summary of the memo:
- Infant formulas imported into the U.S. as a result of the 2022 FDA Infant Formula Enforcement Discretion Policy may be served in the CACFP to meet the requirements of a reimbursable meal.
- Mixing instructions on packaging may use the metric system. For additional guidance, visit the Tips for Preparing Imported Infant Formula page.
- Formulas will be imported until January 6, 2023. Imports after January 6, 2023 will be determined on a case by case basis.

All Sponsors, except for Sponsors of Adult Day Care Centers, are required to post the Building for the Future Flyer. Flyers must be posted in a visible location at all approved CACFP site locations, including administrative offices.
This flyer notifies parents, guardians, and participants that your organization is participating in the CACFP and provides information on who to contact if there are concerns.
The flyer was updated in November 2019 and can be downloaded from the USDA Building for the Future page. Posters are available in English and Spanish. Please note that Sponsors are required to add their contact information to the flyer. Due to this requirement, ODE CNP will not be printing out copies of the flyer.
Family Day Care Home Sponsors are the only Sponsors who can use the Building for the Future pamphlets.

All Child Nutrition Program Sponsors are required to have an Unique Entity Identifier (UEI) per 2 CFR § 25.300. This is required for all recipients who receive Federal funding.
Previously, Sponsors were required to have a DUNS number, and this has been updated to the UEI. Sponsors who do not have a UEI number can go to SAM.gov. Those who are unsure about how to navigate the webiste can also view the Getting a Unique Entity ID Video.
Not having an UEI may mean that your claims are not able to be paid. Sponsors who do not have a valid UEI will be contacted by ODE CNP staff.
