Official Notice of ESB Program Project Threshold Increases

To all ESB Certified Firms –

Today we are excited to announce the official launch of the new Emerging Small Business (ESB) Program per project thresholds and key requirements you will all need to consider as you engage in projects funded through the ESB Program Fund under these new guidelines. These new guidelines have been made possible with the passage of Enrolled HB3055 – 2021 Regular Session.

Below is a summary of how these requirements can now be utilized.  You will note that there is a difference between projects subject to ORS 279B (Goods & Trade Services) and projects subject to ORS 279C (Public Improvements).  The key difference is that the per project limit for Goods & Trade Services shall not exceed $150,000 and the per project limit for Public Improvements shall not exceed $250,000.

ODOT will continue to offer a variety of projects of various size and service type to provide diverse opportunities for ESB Certified Firms from all business sectors. As before, all ESB Projects will be solicited on the OregonBuys Procurement System. 

Key Factors for ESB Certified Firms:

Projects subject to ORS 279B (Goods & Trade Services) – Procurements related to the acquisition of Goods, minor alterations, ordinary repair or maintenance necessary to preserve a public improvement.

  • Projects cannot exceed a total contract cost of $150,000
  • Projects will be advertised on the OregonBuys Statewide Procurement System
  • ODOT may require attendance to a Mandatory Pre-Bid as outlined in the Request for Competitive Quotes

Projects subject to ORS 279C (Public Improvements) – A procurement for construction, reconstruction or major renovation on real property by or for a contracting agency.

  • Projects cannot exceed a total contract cost of $250,000
  • Performance and Payment Bonds will be required for projects estimated over $100,000
  • First-tier subcontractor disclosure is required on public improvement contracts estimated to be more than $100,000
  • Bid Security (Bid Bond) will not be required
  • Projects will be advertised on the OregonBuys Statewide Procurement System
  • ODOT may require attendance to a Mandatory Pre-Bid as outlined in the Request for Competitive Quotes
