Federal Permit: NWP-2023-662, Section 404, Clean Water Act
On December 2nd, the US Army Corps of Engineers (USACE) withdrew the federal permit application for the Neptune’s Vault Offshore Wine Storage project (NWP-2023-662), in anticipation of a revised site location to be proposed by the project applicant following consultation with the Oregon Department of Land Conservation and Development (DLCD) and Oregon Department of Fish and Wildlife (ODFW). The withdrawal of the permit application from active federal review subsequently halted the current federal consistency review of the project by the Oregon Coastal Management Program.
Upon reinitiation of active federal permit review by USACE, the OCMP will also initiate a new federal consistency review of the project, including a new public comment period. Any public comments associated with the prior review of the project may be applied to a future review of the revised proposal, and would not need to be resubmitted.
The review process under the jurisdiction of the Department of State Lands is not affected by the federal permit withdrawal and is expected to continue. This project will also be on the agenda of the December 11th meeting of the Ocean Policy Advisory Council. More information about the OPAC meeting may be found here: OPAC December 11 Meeting.
