Floodplain Announcement: DLCD FAQ for FEMA's PICM

The Oregon Department of Land Conservation and Development (DLCD) posted a set of frequently asked questions and answers (FAQ - October 4, 2024) about the Pre-Implementation Compliance Measures (PICM) from the Federal Emergency Management Agency (FEMA). The FAQ addresses questions from Oregon cities and counties about how PICM would work within Oregon land use planning. 

This FAQ is general guidance based on the information available to DLCD staff at this time. It is not a DLCD decision. It is not legal advice for any specific situation. Cities and counties should consult their legal counsel for advice on specific decisions.

FEMA Workshops 

Earlier this week, FEMA sent invitations to NFIP communities for virtual and in-person workshops on their Pre-Implementation Compliance Measures between October 16 and November 19, 2024. 

Each workshop will focus on either the model ordinance or permit-by-permit habitat assessment and mitigation. Information about the third option, prohibit all new development in the floodplain, will be provided through guidance documents. 

Please email FEMA at fema-r10-mit-picm@fema.dhs.gov for information on attending a PICM workshop.

Geographic Area 

If your city or county is outside of the BiOp Implementation area, then you can disregard this announcement. FEMA has posted instructions on how to determine if you are in the FEMA BiOp Implementation area. 


Oregon NFIP BiOP Action Area

The Bi-Op Implementation Plan Area is defined by the boundaries of six NOAA Salmon and Steelhead Recovery Domains within the State of Oregon: Oregon Coast, Southern Oregon, Willamette River, Lower Columbia River, Middle Columbia River, and Snake River.
