Proposed New Rules to Guide Development of Middle Housing Types and Middle Housing Model Code

The Land Conservation and Development Commission (LCDC) is considering adoption of new administrative rules to prescribe standards guiding the development of Middle Housing types as provided in Oregon Law 2019, Chapter 639. The proposed administrative rules create a new division in OAR Chapter 660 - OAR 660-046. The new statutes under ORS 197.758 require rules for middle housing provisions in medium cities and the adoption of a middle housing model code.

The Department of Land Conservation and Development (DLCD) is soliciting public comment regarding the proposed new rules. The proposed new rules to guide development of middle housing types and the middle housing model code will be at OAR 660, division 46.

LCDC is holding its first public hearing for this rulemaking on May 21, 2020. LCDC will hold a final public hearing, and may adopt the new rules on July 23, 2020. Interested persons may provide oral and written testimony to LCDC regarding the proposed new rules at the hearing, and are encouraged to send written comments in advance of the hearing. Oral and written testimony will be accepted until the close of the hearing. The hearing on this topic is scheduled to begin at 8:30 a.m. on May 21, 2020.
