House Bill 2001 and HB 2003 Updates

With HB 2001 and HB 2003 underway, there is a lot of work and involvement happening at the Department of Land Conservation and Development (DLCD) to ensure the timely and effective implementation of each bill. The purpose of this message is to provide an overall update on project rulemaking, planning assistance funding, community outreach, and important upcoming events and dates.

Rulemaking Advisory Committee (RAC) Meeting #3

The RAC held its third meeting on January 22nd. In this meeting, Oregon Housing and Community Services (OHCS) gave a presentation on regional housing needs analysis methodology. Additionally, RAC members discussed provisions outlined in HB 2003 regarding Housing Production Strategies. Finally, the project team delivered a summary from the first Middle Housing Model Code Technical Advisory Committee results and next steps.

Infrastructure-based Time Extension Request Technical Advisory Committee (IBTERTAC) Meeting #1

The IBTERTAC held its first meeting on January 29th. In this first meeting, IBTERTAC members discussed the details and implications of terms and timelines outlined in HB 2001. Members shared challenges and anticipated impacts from a variety of perspectives, including local jurisdictions, builders, and engineers. Balancing flexibility for jurisdictions facing hardship and ensuring the timely implementation of HB 2001 is a key priority for the IBTERTAC moving forward. Administrative rules for the Infrastructure-based Time Extension Request (IBTER) are expected to be complete by the end of July 2020. As established in HB 2001, the IBTER application deadline for cities with a population between 10,000 and 25,000 is December 31, 2020. Non-Portland Metro cities with more than 25,000, cities within Portland Metro with more than 1,000, and Portland Metro Counties have until June 30, 2021 to submit the request for extension.

Middle Housing Model Code Technical Advisory Committee (MCTAC) Meeting #2

The MCTAC held its second meeting on February 4th. A key priority of the MCTAC is developing a model code that strives to provide affordable living choices, acknowledges the importance of reasonable regulations, and strive to result in equitable outcomes. In this meeting, members discussed the details and implications of various terms and development standards outlined in a draft Model Code for medium cities (i.e. Non-Metro cities with a population between 10,000 and 25,000). This discussion will inform the project team on needed refinement of the Model Code prior to anticipated Land Conservation and Development Commission review in May.

Housing Production Strategy Technical Advisory Committee (HPSTAC) Meeting #1

The HPSTAC held its first meeting on February 6th. The purpose of this meeting was to provide an overview of the HPSTAC role and deliverables in context to HB 2003 and discuss preliminary Housing Production Strategy (HPS) concepts and elements as outlined in the bill. Primary focuses of this meeting included reporting and data requirements, specific actions, policies, and tools future housing production strategies should consider, community engagement requirements, and details regarding enforcement and evaluation.

Planning Assistance for Local Jurisdictions

House Bill 2001 and House Bill 2003 provides a total of $4.5 million to DLCD to provide planning assistance to local governments to implement key provisions of the bill. These include:

  • Developing regulations to allow duplexes and other housing specified in the bill.
  • Developing plans to improve water, sewer, storm drainage, and transportation services in areas where duplexes and other traditional housing would not be feasible due to service constraints.
  • Complete required housing needs analysis and production strategies.

The department has distributed a Request for Assistance form to eligible local jurisdictions and encourages them to apply for assistance. The due date for this form is March 13, 2020. Planning assistance is expected to be provided from mid-2020 to June 30, 2021, the deadline for local laws to be updated. Community Conversations and Focus Groups

The project team held two community conversations in the Portland Metro area on January 29th and 30th to discuss new Oregon housing initiatives and solicit feedback from community members about their hopes, concerns, and questions about HB 2001 and HB 2003. Insights from these conversations will be used to inform rulemaking moving forward. This coming week, project team members will be traveling to Eastern Oregon to hold community conversations in Hermiston and Redmond (details below). If you are available, we would love to hear your feedback!

One focus of community engagement efforts is to hear the needs and voices of under-represented communities, especially from organizations whose missions are rooted in advocating for the needs of marginalized, low-income, renters, and communities of color. To start this work, the project team is holding focus groups beginning in March to solicit input from community organizations who serve members from African-American communities, Native American communities, Disabilities communities, Elderly Adults population, and low-income renters. Their feedback will help guide equity conversations in the rulemaking process.
