ODHS - ODDS Notice of Proposed Rulemaking (COVID-19 and Civil Penalties for CDDPs and Brokerages)

You are subscribed to receive notification of rulemakings for the Office of Developmental Disabilities Services (ODDS). 

Due to the Coronavirus (COVID-19) state of emergency, the Oregon Department of Human Services (ODHS), Office of Developmental Disabilities Services (ODDS) immediately adopted OARs 411-320-0210 and 411-340-0190 about Civil Penalties for Community Developmental Disabilities Programs (CDDPs) and Brokerages to:

  • Require CDDPs and Brokerages to implement all directives to reduce the spread of COVID-19; and
  • Allow ODDS to impose a civil penalty according to ORS 427.900 if a CDDP or Brokerage does not implement all directives to reduce the spread of COVID-19.

The temporary rules went into effect on December 2, 2020. ODDS is now proposing to make the temporary rule changes permanent.

Other changes may be made to these rules to correct grammatical errors, ensure consistent terminology, address issues identified during the public comment period, and improve the accuracy, structure, and clarity of the rules.

A public hearing regarding the proposed rulemaking is scheduled for April 26, 2021 at 11:30 a.m. The public hearing will be conducted by phone only. The public is welcome to participate and provide comments by calling 1-971-277-2343 and entering 916 269 659#.

Written comments may also be submitted prior to the public hearing until April 30, 2021 at 5:00 p.m. Written comments may be submitted by e-mail to christina.hartman@dhsoha.state.or.us or mailed to 500 Summer Street NE, E-09, Salem, Oregon, 97301-1073. All comments received will be given equal consideration before ODDS proceeds with permanent rulemaking.
