On Aug. 15, 2017, Governor Kate Brown signed into law House Bill 3391, known as the Reproductive Health Equity Act (RHEA). This bill codified the right to abortion in Oregon and enacted the following changes:
For private insurance consumers:
- Requires Oregon plans to cover a full range of reproductive services (including abortion and vasectomy) without any cost-sharing requirements to all eligible beneficiaries.
- Prohibits insurers from discriminating against, or denying benefits to, individuals on the basis of gender identity, sexual orientation, disability, age, national origin, sex or race.
For individuals who are able to become pregnant and who would be eligible for medical assistance if not for their immigration status:
- Covers a full range of reproductive health services, including female sterilization and abortion, through OHA's Reproductive Health Program.
- Eligible individuals include undocumented residents, DACA recipients, and individuals eligible for CAWEM Plus or CAWEM-only coverage.
- CAWEM Plus (CWX) members can access these services from Oregon Medicaid providers who serve open-card (fee-for-service) members; and remain eligible for CAWEM Plus comprehensive medical coverage for 60 days post-partum.
- To learn how CAWEM-only (CWM) members and other eligible individuals can access these services, read OHA's fact sheet.
