Oregon DHS - ODDS Temporary Rulemaking (COVID-19 and Civil Penalties for CDDPs and Brokerages)

Due to the Coronavirus (COVID-19) state of emergency, the Oregon Department of Human Services (ODHS), Office of Developmental Disabilities Services (ODDS) is immediately adopting OARs 411-320-0210 and 411-340-0190 about Civil Penalties for Community Developmental Disabilities Programs (CDDPs) and Brokerages.
The temporary rules:
- Require CDDPs and Brokerages to implement all directives to reduce the spread of COVID-19; and
- Allow ODDS to impose a civil penalty according to ORS 427.900 if a CDDP or Brokerage does not implement all directives to reduce the spread of COVID-19.
The temporary rules are in effect from December 2, 2020 through May 30, 2021.
