 This is a notice of upcoming rulemaking actions, including Rulemaking Advisory Committees (RACs) and Public Hearings, that will be conducted by the Department of Early learning and Care (DELC).
Certified Family Child Care Rulemaking
DELC is proposing permanent rules for certified family child care homes. The changes remove or reframe duplicative requirements, add rules that were omitted from the original filing due to administrative error, and clarify provisions that have caused confusion during implementation. In addition, the amendments make permanent the temporary rules designed to protect children from specific hazards.

The Early Learning Council (ELC) will receive initial notice on the proposed changes to this ruleset at the October 2, 2025 ELC meeting. If passed, the rules will be effective January 1, 2026.
RAC meeting: October 7, 2025 from 6:00pm-7:30pm on Zoom.
Public Hearing: November 12, 5:00-6:00 PM on Zoom. Department staff will open the public hearing at 5:00 PM. If no attendees have joined by 5:15 PM, staff will close the public hearing.
The public comment period is open until 5:00pm on November 28, 2025.
Birth Through Five Literacy Rulemaking
DELC will begin the administrative rulemaking process as stated in HB 3198 (2023) to clarify the purpose of the Birth Through Five Literacy Plan and outline how funding will be administered across grants and contracts, streamlining guidance across programs.

The Early Learning Council (ELC) will receive initial notice on the proposed changes to this ruleset at the October 2, 2025 ELC meeting. If passed, the rules will be effective January 1, 2026.

Early Childhood Education Workforce Registry Rulemaking
DELC will begin the administrative rulemaking process as stated in HB 2991 (2023) to address barriers that impede entry into the early childhood workforce. The rules require the Early Childhood Education Workforce Registry (housed at the Oregon Center for Career Development at Portland State University) to create a career pathway system that expands professional development options in the professional development recognition system, ensure that the early learning workforce may have registry related documents translated free of charge, maintain a process for verifying Out-of-State Professional Development, and ensure that a system is created for employers to have access to staff professional development records for the purposes of technical assistance, with permission from the professional.

Employment Related Day Care Program (ERDC) Rulemaking
DELC is proposing permanent rules to update the Employment Related Day Care Program (ERDC). The changes update the ERDC waitlist, allowing DELC more flexibility in managing exemption criteria, provides more clarity on verification requirements and general financial eligibility to align with ODHS program rules for consistency, updates rules to reflect 2026 child care provider rates and consolidates language on high needs child care payments.
The Early Learning Council (ELC) will receive initial notice on the proposed changes to this ruleset at the November 19, 2025, meeting. If passed, the rules will be effective January 1, 2026.
