House Bill 2807 Becomes Law

House Bill 2807 became law just as Oklahoma’s legislative session draws to a close this week.

As part of the rulemaking process, OMMA has submitted proposed emergency rules to the Governor to implement House Bill 2807. The emergency rules are intended to provide a structure for the implementation of legislative requirements as permanent rules cannot be promulgated until 2026. If approved, these emergency rules will go into effect immediately upon the Governor’s signature.

You can view the proposed emergency rules on our Rulemaking Process webpage under “OMMA Rules Through the Years,” but in this email, we wanted to quickly address some important aspects of House Bill 2807 impacting commercial licensees. Among other things, House Bill 2807 updates the pre-pack requirements mandated by House Bill 3361 from 2024. Pertaining to pre-pack, House Bill 2807:

  • Provides dispensaries a grace period for deli-style flower. Licensed medical marijuana dispensaries will have until Nov. 1, 2025, to sell or waste deli-style inventory that was received before June 1.
  • Clarifies what needs to be pre-packaged. Beginning June 1, all medical marijuana flower, trim, shake, kief, noninfused pre-rolls, infused pre-rolls or other flower-based product not defined as a concentrate must be sold by licensed medical marijuana processors and licensed medical marijuana commercial growers to licensed medical marijuana dispensaries only in pre-packaged form in package sizes weighing not less than one-half (1/2) of one (1) gram to not more than three (3) ounces. 

In addition to the pre-pack updates, House Bill 2807 allows commercial transporter licensees to use warehouse locations to temporarily store medical marijuana, medical marijuana concentrate and medical marijuana products. OMMA is working on the internal processes necessary to implement the warehousing portion in House Bill 2807.
