REMINDER: EXEMPTIONS

The Ohio Revised Code (ORC) 4749.01 outlines the positions and duties of private investigator and security guard services. Among other supporting information, this code also contains exemptions to the required licensing of these services.

Exemptions contained in ORC 4749.01 can include: commissioned peace officer working for a licensed security or investigation company, attorneys or experts hired by attorneys for consultation/litigation, genealogical researchers, or better business agencies.

If you are not working under one of the exemptions contained in ORC 4749.01, you are required to have a license, as well as register security guards and private investigators when providing the services below for hire:

SECURITY: watchpersons, guards, guard dogs, armored vehicle security services, private patrol officers, or other persons whose primary duties are to protect persons or property.

Examples of security jobs include, but are not limited to; patrolling business perimeter/parking lots, checking visitors before granting access to a facility, standing fire watch, guarding events such as football games or concerts, or providing armored car service.

INVESTIGATION: includes gathering information relevant to any crime committed or threatened. It may also include obtaining information on the identity, habits, conduct, movements, whereabouts, affiliations, transactions, reputation, credibility, or character of any person, or to locate and recover lost or stolen property, or to determine the cause of or responsibility for any libel or slander, or any fire, accident, or damage to property, or to secure evidence for use in any legislative, administrative, or judicial investigation or proceeding.

Examples of investigation jobs include, but are not limited to; investigating a house fire, locating a missing person, and conducting surveillance on an individual’s movements or conduct.
