Notice of Public Rules Hearing

In accordance with Chapter 119 of the Revised Code (R.C.), the Director of the Ohio Department of Health announces a Public Hearing at the date and time listed above to hear comments regarding the following action:
3701-49-01.1, 3701-55-02, 3701-55-20 - Fees for Laboratory Services, Required Newborn Screenings, and Fees for Genetic Services, and Sickle Cell
Ohio Administrative Code (OAC) 3701-49-01.1 lists the fees which the ODH Director (Director) may charge for specific tests conducted at the ODH Public Health Laboratory (PHL). The rule is amended to increase the newborn screening fee from $63.46 to $138.51. OAC 3701-55-02 requires hospitals and freestanding birthing centers to screen all Ohio-born newborns for certain genetic, endocrine, and metabolic disorders as part of ODH’s newborn screening program. The rule is
amended to expand the list from thirty-nine disorders to forty-two. OAC 3701-55-20 requires the Director to charge a fee for performing genetic, endocrine, and metabolic disorder screenings required by ORC 3701.501 and OAC Chapter 3701-55, with the money collected by the fee deposited in Ohio’s genetic services fund and sickle cell fund and dispersed to defray the costs of various programs. The rule is amended to increase the fee from $35.17 to $46.49 and revise both the amounts that are deposited in the funds and how they are dispersed.
