Notice of Public Rules Hearing

In accordance with Chapter 119 of the Revised Code (R.C.), the Director of the Ohio Department of Health announces a Public Hearing at the date and time listed above to hear comments regarding the following action:
3701-21-24 - Food Service Operations
This rule package consists of one amended rule proposed by the Ohio Department of Health (ODH) as part of the statutory five-year review process. This rule package was submitted to the CSI Office on April 4, 2024, and the public comment period was held open through April 14, 2024. This rule establishes requirements for ODH to survey the food service operation program of a licensor. The rule states that each program will be surveyed at least once every three years and lists the survey methodology. The rule also sets forth procedures for classification of programs as approved or provisional. The rule is amended to include requirements for conducting written and electronic assessments, including timeframes for assessment and requirements concerning the length of the assessment. The rule also includes amendments that set forth the criteria for provisional classification, include contents to be included in a survey report, establish the requirements for reevaluation, and allow for electronic or mailed requests for informal hearings.
3701-68-01 - Women's Health Services
This rule package consists of one amended rule proposed by the Ohio Department of Health (ODH) as part of the statutory five-year review process. This rule package was submitted to the CSI Office on May 30, 2024, and the public comment period was held open through June 28, 2024. This rule establishes requirements concerning grant funding for the provision of women’s health services, including relevant definitions, eligibility criteria, and award priority. The rule includes amendments that update the definition for “women’s health services” to include diagnosis of cervical cancer and additional examples of screening and diagnosis procedures. Amendments also update definitions concerning screening and treatment of sexually transmitted infections, vaping education and counseling, and preconception, prenatal, and postpartum care, as well as remove unnecessary regulatory restrictions.

Any such person may be represented by an attorney, present their positions, arguments, or contentions orally or in writing, may offer witnesses, and may present evidence tending to show that the proposed rule, if adopted or effectuated, will be unreasonable or unlawful. The public hearing is open to the public and will be held in-person in Basement Conference Room A/B at 35 E. Chestnut Street, Columbus, Ohio on July 30, 2024 at 12:30pm.
