Notice of Public Rules Hearing

In accordance with Chapter 119 of the Revised Code (R.C.), the Director of the Ohio Department of Health announces a Public Hearing at the date and time listed above to hear comments regarding the following action:
3701-70 - Fetal Infant Mortality Review
This rule package consists of four new rules proposed by the Ohio Department of Health (ODH). Chapter 3701-70 is a new chapter that establishes requirements for the Ohio Fetal Infant Mortality Review (FIMR) program, which is created to identify and develop recommendations for reducing local infant mortality issues.
3717-1 - Ohio Uniform Food Safety Code
This rule package consists of forty amended rules and four no-change rules proposed by the Ohio Department of Health (ODH) as part of the statutory five-year review process. This rule package contains definitions pertaining to the Ohio Uniform Food Safety Code, provides for the determination of the primary business by a licensor when the activities of a food service operation (FSO) and a retail food establishment (RFE) are conducted within the same facility, contain requirements for FSO and RFE food management and personnel with respect to employee health, personal cleanliness, hygienic practices, and supervision, requires food employees to use gloves to cover bandages, finger cots, or finger stalls, declare that the assignment of responsibility provision does not apply to vending machine locations, require a person in charge to identify sesame as a major food allergen, require a person in charge to ensure that food employees are properly maintaining the temperature of time/temperature controlled for safety foods during thawing, describe food allergy awareness as it relates to proper food safety training, add clarifying language, remove unnecessary language, add a citation, and update language and citations.

They may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence showing that the proposed rule, if adopted or effectuated, will be unreasonable or unlawful.
