Physical Therapy Assistants and Occupational Therapy Assistants

Governor Kathy Hochul recently signed an amendment into law allowing occupational therapy assistants and physical therapy assistants (under the direction and supervision of a Board-authorized occupational or physical therapist) to treat injured workers in the New York State workers’ compensation system. This amendment to Section 13-b of the Workers’ Compensation Law takes effect on October 27, 2024. To help implement this law and provide billing guidance, the Board is adopting a Notice of Emergency Adoption and Proposed Rulemaking to provide guidance.

This emergency adoption and proposal will be published soon in the State Register, posted to the Board’s website, and will be communicated via a Subject Number once available. The Emergency Adoption takes effect October 27, 2024, but there will be a 60-day public comment period following publication in the State Register.
