Important Information Regarding Form RFA-1LC and Form RFA-2
The following are important reminders regarding the Workers’ Compensation Board’s (Board’s) Request for Further Action by Legal Counsel (Form RFA-1LC) and the Request for Further Action by Carrier/Employer (Form RFA-2).
Form RFA-1LC and Form RFA-2 each include a certification statement that provides that the request for Board action is based upon reasonable grounds and any attachments to the form have been provided to opposing parties.
The certification statement also indicates that the matter was discussed with opposing parties and (a) no settlement of the issues could be reached or (b) settlement on the issues was reached, or that contact with opposing parties to discuss a settlement was attempted, but no discussion was forthcoming after a reasonable time for a response elapsed.
If the certification statement at the bottom of Form RFA-1LC or Form RFA-2 is not properly completed and certified (no checkbox has been marked and/or the legal representative certified without checking a box), no action will be taken by the Board and correspondence will be issued informing all parties of interest of this determination.
