Notification of Change to Measurement to First Report of Injury (FROI)

 

The New York State Workers' Compensation Board (Board) has made a change in regard to a measurement of the First Report of Injury (FROI). After analytics were completed, it was determined that the First Report of Injury was not being measured in all circumstances. These instances include cases in which the claimant did not initially lose time from work, or the FROI was filed improperly by not containing the Initial Date of Disability. Due to these findings, the Board will now measure the First Report of Injury once any transaction is received showing the claim is a lost time case. The transaction could be a FROI or a SROI giving the initial date of disability.

 

In addition, the Board realized that they were only excluding cases from measurement in which the Type of Loss Code (DN0290) was 02 - Occupational Disease, and should also be excluding cases in which the Type of Loss Code was 03 - Cumulative Injury.

 

Both of these changes took effect for transactions received July 1, 2016, or after.
