Statewide - Notice is hereby given that the New York State Department of Environmental Conservation (DEC) is proposing to amend 6 NYCRR Part 375, Environmental Remediation Programs. This rulemaking was previously proposed and revised in 2024. The package is being re-proposed without changes to comply with NYS Administrative Rules. All comments on the previous proposal and revised proposal were considered and addressed; these responses are available on the Department’s website. A public comment hearing will be held on October 1, 2025, and the public comment period for this proposed rulemaking will end on October 7, 2025.
The rulemaking amends 6 NYCRR Part 375 to conform to the 2015 and 2022 Amendments to DEC regulations with respect to the Brownfield Cleanup Program (BCP); addresses and enhances requirements pertaining to the State Superfund Program (SSF) and the Environmental Restoration Program (ERP); and updates the soil cleanup objectives (SCOs).
A public comment period for the proposed rulemaking will be held until October 7, 2025. A virtual public comment hearing for the revised rule will be held on October 1, 2025, at 3:30 p.m. via WebEx electronic webinar.
