Revised Program Policy DER-32: Brownfield Cleanup Program Applications and Agreements

Revised DER-32 was Issued July 28, 2017; Effective September 8, 2017

Program Policy DER-32 has been revised and the final document is available on DEC’s website at http://www.dec.ny.gov/regulations/2393.html. This policy provides guidance on:

  • application process and the general terms and conditions for the Brownfield Cleanup Agreements (BCAs) under DEC’s Brownfield Cleanup Program (BCP); and
  • process to amend and terminate a BCA.

DER-32 has also been revised to comport with the most recent amendments to Article 27, Title 14 of the Environmental Conservation Law.
