Amendments of 20.2.77 NMAC, New Source Performance Standards; 20.2.78 NMAC, Emission Standards for Hazardous Air Pollutants; and 20.2.82 NMAC, Maximum Achievable Control Technology Standards for Source Categories of Hazardous Air Pollutants.

On November 17, 2023 the Environmental Improvement Board (Board) held a public hearing to consider the New Mexico Environment Department’s (Department) proposal to amend 20.2.77 NMAC, New Source Performance Standards; 20.2.78 NMAC, Emission Standards for Hazardous Air Pollutants; and 20.2.82 NMAC, Maximum Achievable Control Technology Standards for Source Categories of Hazardous Air Pollutants. The Board deliberated on the hearing record and unanimously adopted the Department’s proposal. The effective date of these amendments is December 19, 2023. Pursuant to the State Rules Act (Sections 14-4-5-D and 14-4-5.5 NMSA 1978), the adopted amendments and a concise explanatory statement containing the statutory authority and findings can be viewed at https://www.env.nm.gov/airquality/proposed-regs/.
