AQB Permitting COVID-19 Pandemic Response Information
We now accept electronic submittal of applications!
The Air Quality Bureau staff are teleworking, and we appreciate that many of you are as well. In response to your requests we’ve devised a way to accept electronic pre-submittals of permitting actions (Notices of Intent, GCP registrations, and permit applications). Please read this information thoroughly, as we need your help to ensure it goes smoothly. Electronic submittals must follow this process carefully to ensure successful submittal and acceptance.
Hard Copies and the Normal Process Still Available!
Our normal, hard copy submittal process is still available! You are welcome to submit permitting actions as you always have and as explained in our forms. If you have a traditional (wet-ink) notary, the quickest way to get your permitting action to a permit writer is to follow the normal, hard copy process. You will be requested to e-mail or file transfer the permitting action documents to your assigned permit writer. Your electronic documents must have a copy of your notarized certification page. Watch for their email, and please respond quickly.
No Electronic Payments, Sorry!
We cannot accept electronic payments; paper checks are still required. Review of a permitting action cannot begin until the required payment is received. The applications will be date stamped on the date AQB has both your electronic application and the associated check.
Electronic Pre-Submittal Process is Available During the COVID-19 Pandemic!
- Prepare and Remotely Notarize your Permitting Action: Use the normal forms (including the required attachments) and have your action remotely notarized. You must use a certified notary in a state that allows remote notarization. An ‘electronic signature’ is not sufficient; it must be notarized per the legal remote notary process.
- Pre-Submit: Fill out our online form to notify the Department you would like to submit a remotely notarized permitting action. The information requested in this form is what we need to get your permitting action into the system and assigned to a permit writer. (This step is similar to us opening the mail for a hard copy submittal.)
- Pay the Fee: Mail your paper check. We will match your check to your pre-submittal information. This step could delay assignment of your project if we are unable to match your check to the pre-submittal information. The form requires the check number and the payor, and you must include the facility name on the memo of the check.
- Submit Electronically: Electronically submit your (remotely notarized) permitting action documents via email or file transfer when requested by your assigned permit writer. We cannot accept zipped files via email. If your attachments are over about 20 MB, you’ll need to use our file transfer service (Accellion). Your permit writer will initiate the file transfer process if files are too large to email. If we already have your check, this is the step that will start the regulatory deadline, so please respond to the permit writer’s email quickly. NOTE: NOTE: If you are submitting a Title V action or a New Source Review action, it is required that you mail a hard copy as well. This hard copy does not need to be notarized as it is for the permit writer’s convenience for review. Registrations for GCPs do not require hard copies.
Remote Notary

New Mexico does not have its own remote notary laws, so notaries in NM cannot perform remote notarizations. However, a person in NM can use an online service to obtain a notary in a state that does allow remote notarization to notarize their documents remotely. New Mexico does accept notaries from states where remote notarization is allowed. When reviewing a remote notary on certifications, we’ll need to verify it was done properly through a certified remote notary in the state that allows remote notarization. Permitting staff cannot answer questions about the remote notary process.
Important Information!
Permit filing fees are non-refundable for permitting actions that are electronically submitted without being notarized. If the permitting action is not properly notarized, the action will be denied.
Please be prepared to respond to requests to email or file transfer your permitting action documents to ensure early date-stamping of your application.
AQB staff may block their outgoing caller ID when using personal phones to contact customers and will check voicemail messages left on work phones. E-mail is likely the most effective way to alert your permit writer if you need an urgent response.
