Notaries May Now Renew Commission After Health Emergency; Clerk’s Office to Honor Existing Appointments

TRENTON - In light of the recent executive order by Governor Phil Murphy extending the deadline for notaries public to renew their commission to 90 days after the current Public Health Emergency (PHE) ends, the Mercer County Clerk’s Office will honor all current appointments but will only make new appointments under emergency circumstances.

The new order allows any notaries public whose existing commissions have expired during the PHE (March 2020-present) to continue to execute notarial acts as long as they enter the commission expiration date shown on their most recent renewal certificate when doing so. If they fail to renew their commission during the 90-day period following the last day of the PHE, their commissions will expire and they will have to reapply in order to conduct notarial acts. 

Additionally, the provision requires each notary public to take an oath before the county clerk where the notary public resides or works no more than three months after the notary public has received their commission. Notaries are still required to do so, but the new provision will extend the time period to take the oath to 90 days after the end of the PHE. The State of New Jersey may declare an end to this emergency in the near future.

In order to schedule a swearing-in, you may contact the Mercer County Clerk’s Office at 609-989-6820. The cost is $15; checks or money order will be accepted. Prospective notaries will also need a photo ID and their certificate on hand to be sworn in.
