Public Notice
Take notice that the New Jersey Department of Environmental Protection (Department) is proposing to extend the initial 180-day legacy period for the NJPACT REAL rules adopted on January 20, 2026. The Department is proposing to extend the legacy period until July 20, 2027. The Department seeks to extend the legacy period to allow the Department to determine if targeted amendments to the NJPACT REAL rules would streamline or simplify permit reviews, in accordance with the directives of Governor Sherrill’s Executive Order 5, while still serving the rules’ critical goals. During the extended legacy period, the Department would engage with interested parties including residents, municipalities, counties, regional planning entities, real estate developers, and members of the environmental, business, insurance, and real estate communities to identify potential amendments. Once identified, any proposed rule amendments would be taken forward pursuant to the process set forth in the Administrative Procedure Act.
The public notice of the proposal is scheduled to be published in the New Jersey Register dated June 1, 2026. This notice of proposal is published pursuant to N.J.S.A. 52:14B-4.10. A virtual public hearing is scheduled for July 7, 2026, at 6:00 p.m., and additional information is available on the Department’s website at https://dep.nj.gov/njreal/.
If you are interested in providing oral testimony or submitting written comments at a public hearing, please register no later than 5:00 P.M. on July 5, 2026, at https://dep.nj.gov/njreal/. You must provide a valid email address so the Department can send you a confirmation of your interest to testify orally at the hearing. It is requested (but not required) that anyone providing oral testimony at the public hearing provide a copy of any prepared text to the Department at the hearing. Please note the Department will take oral testimony at the hearing in chronological order based upon when you registered for the event. Further, the hearing will be recorded.
