Notice of Rule Proposal
Remediation Standards – GWQS GenX Amendments, N.J.A.C. 7:9C, 7:26D, and 7:26E.

Take notice that, in accordance with N.J.A.C. 7:9C-1.7(c)2ii, the NJ Department of Environmental Protection (Department) is replacing its interim specific ground water quality criterion for hexafluoropropylene oxide dimer acid and its ammonium salt (collectively known as GenX) with a specific criterion. Also, pursuant to N.J.A.C. 7:26D-6.3, the Department is replacing its interim remediation standards for soil and soil leachate for perfluorononanoic acid (PFNA), perfluorooctane sulfonate (PFOS), perfluorooctanoic acid (PFOA), GenX, and methanol, with promulgated standards through a rulemaking in accordance with the Administrative Procedures Act, N.J.S.A. 52:14B-1 et seq. Additionally, the Department is proposing to amend the Technical Requirements for Site Remediation, Quality Assurance for Sampling and Laboratory Analysis at N.J.A.C. 7:26E-2.1(c)1ii to add GenX, PFNA, PFOS, PFOA, and 2,3,7,8-tetrachlorodibenzo-pdioxin. These chemicals are proposed for addition to the list of contaminants that must be analyzed in all media when contaminants in an area of concern are unknown or not well-documented. The Department is proposing these chemicals for inclusion because they have been widely used or are prevalent in the State.
The proposal is scheduled to be published in the New Jersey Register dated March 17, 2025. The Department will hold a public hearing on the proposal on Thursday, April 17, 2025, at 1:00 P.M. The public hearing will be conducted virtually through the Department’s video conferencing software, Microsoft Teams. virtual public hearing, please email the Department at CSRR_rules@dep.nj.gov, no later than 5:00 P.M. on Wednesday, April 16, 2025, with your contact information (name, organization, telephone number, and email address). You must provide a valid email address, so the Department can send you an email confirming receipt of your interest to testify orally at the hearing and provide you with a separate option for a telephone call-in line if you do not have access to a computer or mobile device that can connect to Microsoft Teams. This hearing will be recorded. It is requested (but not required) that anyone providing oral testimony at the public hearing provide a copy of any prepared remarks to the Department through email.
Written comments are due by May 16, 2025. The Department encourages the submission of comments electronically at https://dep.nj.gov/rules/rule-comment-form/.
