Notice of Rule Proposal and State Implementation Plan Revision Advanced Clean Cars II Program; Low Emission Vehicles; Diesel Powered Motor Vehicles; Gasoline Powered Motor Vehicles; Model Year 2027 or Later Heavy-Duty New Engine and Vehicle Standards and Requirements; Advanced Clean Trucks Program Proposed Amendments: N.J.A.C. 7:27-14.1, 14.3, 15.1, 15.7, 28A.11, 29.2, 29.3, 29.4, 29.5, 29.6, 29.8, 31.3, and 31.4, and 7:27A-3.10 Proposed New Rules: N.J.A.C. 7:27-29A
PUBLIC NOTICE Take notice that the NJ Department of Environmental Protection is proposing the promulgation of new Air Pollution Control rules at N.J.A.C. 7:27-29A, and amendments to N.J.A.C. 7:27-14, -15, -29, and -31, and N.J.A.C. 7:27A-3.10.
The primary component of this rulemaking is the incorporation by reference of California’s Advanced Clean Cars II (ACC II) regulation, which will require manufacturers of passenger cars and light-duty trucks to meet an annual zero-emission vehicle (ZEV) requirement intended to increase the percentage of ZEVs sold in New Jersey that meet the minimum technical requirements. Additionally, the ACC II regulation includes more stringent multi-pollutant exhaust emission standards that manufacturers of internal combustion engine passenger cars, light-duty trucks, and medium-duty vehicles must meet. The Department proposes this rulemaking to reduce emissions of carbon dioxide (CO2) and local air pollutants, like nitrogen oxides (NOx) and fine particulate matter (PM2.5), from the transportation sector.
This rulemaking has other components that will clarify and update several subchapters related to motor vehicles including N.J.A.C. 7:27-14, Control and Prohibition of Air Pollution from Diesel-Powered Motor Vehicles, N.J.A.C. 7:27-15, Control and Prohibition of Air Pollution from Gasoline-Fueled Motor Vehicles, and N.J.A.C. 7:27-28A, Model Year 2027 or Later Heavy-Duty New Engine and Vehicle Standards and Requirements, N.J.A.C. 7:27-29, Low Emission Vehicle (LEV) Program, and N.J.A.C. 7:27-31, Advanced Clean Trucks Program. Additionally, the proposed rulemaking includes penalty provisions at N.J.A.C. 7:27A for the proposed new rules to the Air Pollution Control rules.
The proposal also constitutes a revision to New Jersey’s State Implementation Plan (SIP) for the attainment and maintenance of the National Ambient Air Quality Standards for ozone.
The proposal is scheduled to be published in the New Jersey Register dated August 21, 2023.
