Highlights:

Crossover - May 13, 2021 - This is the date that most bills must pass from one chamber to the other chamber to be eligible for consideration to become session law for the remainder of the 2021-2022 session. The exemption to the Crossover Deadline are bills that affect redistricting; election laws, ratification of amendments to the Constitution of the United States; and bills that must be referred to Appropriations, Finance, or are introduced by the Rules Committee. We are tracking 102 K-12 education bills that "crossed over" the May 13th deadline.

Summer School - Gov. Roy Cooper signed a law (SL 2021-7) requiring school districts offer in-person summer school opportunities for students who have been struggling with virtual learning, and now some local schools are finalizing their plans. See the Education Directory which provides the links to the school districts and click on the link to the district to learn about their summer school plan.

Budget Negotiations - The Office of State Budget and Management forecasts $27.35 million in revenue for the fiscal year starting July 1, plus the $4 billion expected surplus from the current fiscal year. According to Senate President Pro Tempore Berger, the House and Senate are getting closer to an agreement on a target spending number for the state budget. This could be as early as next week - May 17-21. Stay tuned.

Federal Covid Relief - The Biden administration released guidance for spending the American Rescue Plan (ARP) funds this week. North Carolina will get $5.4 billion. See this link from the NC Association of County Commissioners for a breakdown of ARP funds.

- Salary flexibility for school employees; Revise operating balance restrictions for school nutrition programs; Temporarily extend CPR graduation requirements; Revise annual census of school resource officers; Clarify Charter school application fee; Lifetime licensure requirements for professional educators; Combine education and workforce innovation grant programs; Bonuses for teachers and staff for students with visual and hearing impairments; Revise report dates; and
- SBE required to use rulemaking to adopt standards.

H324 Ensuring Dignity & Nondiscrimination/Schools. | Bill Summary

The bill would demonstrate the General Assembly's intent that students, teachers, administrators, and other school employees do the following:
- Respect the dignity of others.
- Acknowledge the right of others to express differing opinions.

S593 Special Education Due Process Hearings. | Bill Summary
Sponsors: B.Jackson; Ballard; Lee
Would allow parties to seek immediate judicial review of administrative law judge (ALJ) decisions in special education due process hearings.
- The State Board of Education (SBE) may enforce the final decision of the administrative law judge by ordering a local educational agency to comply with one or more of the following:
- To provide a child with appropriate education.
- To place a child in a private school that is approved to provide special education and that can provide the child an appropriate education.
- To reimburse parents for reasonable private school placement costs in accordance with this Article and IDEA when it is determined that the LEA did not offer or provide the child with appropriate education and the private school in which the parent placed the child was an approved school and did provide the child an appropriate education.

S695 Statewide Medical Action Plan for Schools. | Bill Summary
Sponsors: Jarvis; Lee; Ballard
Directs the SBE to adopt a statewide medical action plan for all public school units and directs public school units to implement the medical plans.
The plan must include the following:
- A standard student medical condition form to be used for each student.
- A standard student medical action plan form to be used for each student.
- A method to ensure that all persons having supervisory responsibility over a student, including teachers and other public school personnel, volunteers, and chaperones, receive a student medical action plan form for each student whenever the student leaves the campus of the public school unit, including field trips, interscholastic athletic activities, and any other event.
- The bill also directs that local boards of education, charter schools, regional schools, laboratory schools, and the renewal school system implement the medical action adopted by the SBE.

Biennium- A two-year term of legislative activity
Public Bill- Legislation enacted into law that applies to the public at large
Local Bill- Legislation put into law that has limited application (How many counties)- Local bills do not have to be signed by the governor
Sponsor- The legislator who presents a bill or resolution for consideration
Resolution- A document that expresses the sentiment or intent of the legislature or a chamber. Resolutions, when finalized, go to the Secretary of State
