Session Law 2018-145 – Stormwater Controls for Redevelopment

Session Law 2018-145 became effective December 27, 2018.  Section 26.(b) of the new law places the following restrictions on the City of Charlotte’s Post-Construction Stormwater Ordinance:

1)  Stormwater runoff rules and programs shall not require private property owners to install new or increased stormwater controls for preexisting development.

2)  Stormwater runoff rules and programs shall not require private property owners to install new or increased stormwater controls for redevelopment activities that do not remove or decrease existing stormwater controls.

3)  When a preexisting development is redeveloped, either in whole or in part, increased stormwater controls shall only be required for the amount of impervious surface being created that exceeds the amount of impervious surface that existed before the redevelopment.

If you have questions regarding the effect of these restrictions on a specific private development project, please contact the Land Development Division of Engineering & Property Management.
