HB1251 Report (No Stricter Than Review) available on website

Department staff have been working with stakeholders and participants in the Hazardous Waste Forum to develop a group of proposed changes to the hazardous waste rules in Title 10, Division 25 of the Code of State Regulations (10 CSR 25).  House Bill 1251 (HB 1251), passed by the 2012 General Assembly and codified in Section 260.373 RSMo, required the department to identify existing rules in Chapters 3, 4, 5 and 7 of 10 CSR 25 that need to be amended to be consistent with the requirements of Section 260.373. That section limits the authority of the Missouri Hazardous Waste Management Comission (HWMC) to adopt rules that are stricter than, or that establish requirements sooner than, the corresponding federal regulations in certain subject areas.  The department has completed the identification and review process for these chapters and is working on developing the proposed rule amendments that will implement the necessary changes.

Now that the review and identification process is complete, the department, with input from stakeholders, will begin developing the proposed rule amendments, as well as all the required supporting documentation for the amendments.  Additional information about this rulemaking will be posted throughout the rulemaking process as this information is developed.
