MS4 Approaching Deadlines and Details

Dear Small MS4 General Permit Holders/Applicants:
In your efforts to complete your renewal (or new) MS4 permit application, please consider the recently asked questions and responses as follows:
- Renewal applications for Small MS4 General Permits are due by May 14, 2013. We are not granting extensions, because this is a statutory deadline. This is also the application deadline for our 15 new MS4s. Application forms and additional information can be accessed at http://www.dnr.mo.gov/env/wpp/stormwater/sw-local-gov-programs.htm
- The revised SWMP may be submitted later (by July 3rd) under separate cover per Section 2.1.1 of the permit. This Section allows for revised SWMPs to be submitted 90 days following the beginning date of Public Notice (which began April 5th.) If you choose to submit your revised SWMP accordingly by July 3rd, please indicate this in your May 14th application. (This extension does not apply to new applicants.)
- The 30-day public notice period for the draft renewal master permit MOR040000 will end May 6th. There were minor changes, and those changes are noted in the fact sheet at the end of the permit. The document can be viewed at http://www.dnr.mo.gov/env/wpp/permits/pn/R040000.pdf
- Please be cautious about borrowing language from the SWMPs located at http://www.dnr.mo.gov/env/wpp/stormwater/swmp.htm Several MS4s have been provided feedback on their SWMPs, and more reviews are in progress. However, many of the SWMPs posted here have not been modified accordingly, so they may be inadequate. Deficiencies often include a lack of measurable goals, target deadlines and measures for success; as well as confusion over the quality-focused post-construction requirements.
- We do not offer a SWMP template. The template that was used by several communities was provided by an outside party and may not adequately address permit requirements. In one place on the template, it states the MS4 will NOT comply with public input provisions for construction projects (MCM 4). However, such a statement is in conflict with the permit. We recommend considering the questions on the annual report addendum as you work to update your SWMP. http://www.dnr.mo.gov/forms/780-2049-f.pdf
- If you have not established performance criteria for new and redevelopment post-construction runoff quality (long-term), the SWMP will need to spell out an aggressive plan (within the year) to do so. - Annual reports for general permits are due July 28th, for the June to June reporting period. (see link in second bullet)
- The application fee is NOT required by those renewing their permits, because they are already on an annual billing cycle.
- Existing permittees need only submit corrections, additions or deletions to representative outfalls on the existing permit.
- Please notify us of new MS4 contacts/coordinators so we can add them to the listserve.
